Fiji
First harbour. Formal unions, Suva port and crew transit, PALM/RSE outflows, and C188 fishing-labour gaps.
Legal setup
Fiji's Employment Relations Act 2007 (ERA) is the central statute for employment standards, trade-union registration, collective bargaining, mediation, and the Employment Relations Tribunal/Court. The Ministry of Employment, Productivity and Industrial Relations administers labour policy. Freedom of association and collective bargaining are recognised, though essential-services and past Essential National Industries (ENI) restrictions drew sustained ILO and union criticism. Amendment processes in 2023–2025 have sought closer alignment with ILO Conventions 87 and 98.
Key instruments
Employment Relations Act 2007 (as amended)
Core FOA, union registration, CB, grievance and dispute framework
Employment Relations (Administration) Regulations 2008
Procedural rules for mediation, tribunal and union registration
ILO C87 and C98 (ratified)
Foundation for FOA and collective-bargaining compliance pressure
Work in Fishing Convention, 2007 (C188) — gap analysis / compliance work
Relevant to Suva port and fishing-vessel labour standards advocacy
Union formation
Trade unions must register with the Registrar under ERA Part 14; applications require at least seven members, authenticated rules, and officer particulars. Registration may be refused for unlawful objects, non-compliance, inadequate rules, or employer domination. Registered unions may bargain collectively; disputes proceed via mediation services and the Employment Relations Tribunal/Court.
Union landscape
The Fiji Trades Union Congress (FTUC) is the largest national centre (dozens of affiliates across public and private sectors). The Fiji Islands Council of Trade Unions (FICTU) is another centre. Coverage is strongest in public service, sugar, manufacturing, transport and some private formal workplaces. Fishers, seafarers, seasonal PALM/RSE workers, and domestic/informal household workers remain weakly organised relative to need. FTUC has been central to ERA reform and minimum-wage campaigns.
Strengths
- Mature dual-centre union landscape (FTUC and FICTU)
- Statutory registration and collective-bargaining pathways under ERA
- Active tripartite engagement with Ministry and employers
- Documented ILO C188 / fishing-vessel labour advocacy in Fiji waters
- Strong public visibility on minimum wage and FOA reform
- Regional hub role for Pacific union capacity
Gaps
- Limited union reach among fishers and fishing-vessel crew
- Seasonal/PALM workers often outside workplace voice offshore
- Domestic and informal household workers largely unorganised
- Historic essential-industry restrictions damaged FOA practice (reform ongoing)
- Recruitment and grievance gaps for overseas horticulture workers
Notable unions
Fiji Trades Union Congress (FTUC)
Largest national centre; ~35 affiliates; key FOA and wage advocate
Fiji Islands Council of Trade Unions (FICTU)
Second national centre; active on labour-law reform
Sector affiliates (public service, sugar, transport, etc.)
Formal-sector coverage base under FTUC/FICTU umbrellas
