Marshall Islands
Compact labour mobility to the United States, plus fisheries and a thin formal domestic market.
Legal setup
The Republic of the Marshall Islands enacted the Labor (Collective Bargaining) Relations Act 2022, which expressly protects employees' rights to form, join and assist unions, bargain collectively, and engage in lawful concerted activity. Labour administration sits alongside a small national labour market and a globally significant open ship registry that raises flag-state labour-governance questions for seafarers and fishers who may not be Marshallese.
Key instruments
Labor (Collective Bargaining) Relations Act 2022
Statutory FOA, exclusive representation and collective-bargaining rights
Maritime / ship-registry regulatory framework
Flag-state responsibilities for vessels under RMI registry
COFA arrangements with the United States
Shape overseas Marshallese labour mobility
Union formation
The 2022 Act provides a clearer statutory basis for union formation, exclusive representation and collective agreements than earlier practice. Implementation capacity in a micro labour market is still developing; organised density remains limited. Maritime labour questions often arise through flag-state and international standards channels rather than domestic union density.
Union landscape
Domestic union density is low. Formal employment is small; informal and household work dominate local livelihoods. The open registry creates outsized relevance for seafarer and fisher labour standards even when crew are not Marshallese. COFA migration is a major household strategy. No large national centre comparable to FTUC or PNGTUC is established.
Strengths
- Modern 2022 collective-bargaining statute
- Clear statutory language on FOA and concerted activity
- Flag-state leverage for international maritime labour standards
- COFA worker-rights learning pathways
Gaps
- Very limited domestic union organising capacity
- Domestic and informal workers unorganised
- Gap between registry significance and national IR institutions
- Thin enforcement and labour-inspectorate scale
