Polynesia
Samoa
Major Polynesian labour-mobility society; remittances and RSE/PALM work are central to household livelihoods.
Legal setup
Samoa's Labour and Employment Relations Act 2013 (LERA), amended in 2023 (LERAA), is the principal private-sector and SOE employment statute. It expressly protects freedom of association and collective bargaining, administered by the Ministry of Commerce, Industry and Labour (MCIL). Public servants fall under the Public Service Act 2004 and PSC determinations. Samoa has ratified core ILO conventions and maintains an active DWCP (2024–2028).

Union formation
Employees may establish and join organisations; employers must not impose yellow-dog conditions. Unions may bargain collectively in good faith and gain workplace access for recruitment/meetings under the amended LERA framework. Public-service workers organise primarily through the Samoa Public Service Association under the public-service regime rather than LERA.
Union landscape
SPSA is the longstanding public-service union. Private-sector organising exists but is thinner; seasonal PALM/RSE workers and domestic/household workers often lack strong workplace voice despite remittance centrality. MCIL mediates disputes and administers minimum wage. Recruitment costs, family impacts of long absences, and offshore grievance access are live policy issues.
Strengths
- Modern LERA framework with explicit FOA and CB rights
- 2023 amendments strengthening union access and recognition practice
- SPSA as durable public-service workers' organisation
- Active MCIL labour administration and minimum-wage policy
- Current ILO DWCP 2024–2028
Gaps
- Seasonal horticulture workers weakly organised
- Domestic/informal household work outside strong voice
- Private-sector federation depth limited relative to mobility scale
- Offshore grievance and recruitment-cost problems persist

Samoa Public Service Association (SPSA)
