Tonga
Long-standing RSE and PALM sender; remittances are a structural part of the economy and family life.
Legal setup
Tonga's Employment Relations Bill 2020 would modernise FOA and employee-association rights, but as of late 2024 reporting it awaited Royal Assent and was not yet in force. In practice, workers' groups are often incorporated as associations rather than registered trade unions; the older Trade Union Act 1964 is not effectively in force. Public employees are governed by the Public Service Act. Labour mobility (RSE/PALM) dominates workplace-relations stakes more than dense domestic IR institutions.
Key instruments
Employment Relations Bill 2020 (pending commencement)
Proposed modern FOA and employment-relations framework
Public Service Act (revised editions)
Public-employee conditions, discipline and tribunal pathways
Associations practice for workers' organisations
Current practical form of many worker bodies (e.g. teachers)
RSE / PALM sending arrangements
De facto major labour-governance arena for Tongans
Union formation
Until the Employment Relations Bill commences, formation of classical registered trade unions is legally thin; organisations such as FITA operate as associations. Collective voice exists especially in teaching and public service, but statutory union registration/recognition machinery remains incomplete. Honest framing: FOA practice is association-based and mobility-centred.
Union landscape
The Friendly Islands Teachers' Association (FITA) is a principal workers' organisation (Education International / ITUC-linked). Public-service associations also matter. Seasonal horticulture workers — Tonga's largest overseas labour cohort — and domestic/household workers often lack strong representation. Remittances are structural to the economy.
Strengths
- FITA as durable, internationally affiliated teachers' organisation
- Public Service Act provides formal public-employee rules
- Draft Employment Relations Bill signals reform intent
- Deep RSE/PALM experience creates worker-rights learning stock
- Strong remittance policy attention
Gaps
- Employment Relations Bill not yet in force (as of late 2024 reports)
- Seasonal workers weakly organised domestically
- Domestic/informal women workers under-represented
- Offshore grievance mechanisms limited
- Classical trade-union registration pathway incomplete
